YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASKTAPANGO, BOB HARVEST & ASSOCIATES, ITS AFFILIATES, EMPLOYEES, CONTRACTORS, AND PARTNERS SHALL NOT BE LIABLE FOR:
- INDIRECT DAMAGES
- INCIDENTAL DAMAGES
- SPECIAL DAMAGES
- CONSEQUENTIAL DAMAGES
- LOST PROFITS
- LOST DATA
ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD OR THE AMOUNT PAID BY YOU TO ASKTAPANGO DURING THE PREVIOUS TWELVE MONTHS, WHICHEVER IS GREATER.
16. Indemnification
You agree to defend, indemnify, and hold harmless AskTapango, Bob Harvest & Associates, affiliates, employees, contractors, and partners from claims, damages, losses, liabilities, and expenses arising from:
- Your use of the Services
- Your content
- Your violation of these Terms
- Your violation of applicable laws
17. Termination
We may suspend or terminate access at any time for any reason, including violations of these Terms.
Termination does not affect rights or obligations accrued prior to termination.
18. Governing Law
These Terms shall be governed by the laws of the State of Texas, without regard to conflict-of-law principles.
19. Arbitration
Any dispute arising from these Terms shall be resolved through binding arbitration in Tarrant County, Texas, except where prohibited by law.
Each party waives any right to a jury trial or participation in a class action.
20. Changes to Terms
We may modify these Terms from time to time. Updated Terms will be posted with a revised effective date.
Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
